obtaining assistance

veterans may receive assistance filing va disability compensation claim veterans service officers, known vso representatives or veterans service representatives , when affiliated nonprofit veterans service organization. veteran not have pay veterans service officer services. va recommends consulting veterans service officer:



va encourages individuals applying disability compensation work accredited representative ... assist them ... being accredited means organizations , individuals must have va permission represent veterans before department in claims va benefits. purpose of requirement ensure veterans have qualified , competent representation. these individuals receive specialized training in va benefits law , procedure.



although veterans advocates recommend veterans learn how file own claims retain control on process, e.g., ... veterans [should] file own claims without assistance of sort of representative ... except appeal (see post-adjudication representation, below, information regarding legal representation appeals).


the next 2 sections briefly describe 2 types of veterans service officers.


county veterans service officers

county veterans service officers public employees of state s (or territory s) veterans affairs agency. called county veterans service officers, because majority of states have set local veterans affairs offices in each of state s counties.


veterans service officers associated nonprofit veterans service organizations

many not-for-profit veterans service organizations recruit, train, , support own veterans service officers veterans file claims , navigate claims process. in order represent veteran before va, veterans service organization must either have been chartered u.s. congress or have received official approval u.s. department of veterans affairs represent veterans in disability compensation claims process.


post-adjudication representation

veterans may appeal vba s decision regarding compensation claim, , may ask represented accredited veterans service officer, attorney, or claims agent in appeals process. note va not require veteran represented veterans service officer, attorney, or claims agent.


va prohibits attorneys or claims agents charging veteran professional services prior adjudication of veteran s claim. veteran may contract attorney or claims agent represent them in appeal after following 3 conditions have been met:



seal of u.s. court of appeals veterans claims


(1) veteran has filed or disability compensation claim;


(2) claim has been adjudicated (a decision on claim has been made veterans benefits administration); and


(3) veteran has filed notice of disagreement (nod) vba regional office handling or claim.


unless agree work on pro bono basis, attorneys , claims agents represent veterans before veterans benefits administration, board of veterans appeals, , court of appeals veterans claims require payment services. @ federal court level, attorneys work equal access justice act fees. these attorney fees ordered court paid federal government when government s position in litigation not substantially justified.
